Bertram Fields, a top US attorney and Human Rights advocate recently wrote a strongly worded letter to a Marty Rathbun voicing concerns over Marty's "serious invasion of Tom’s privacy and a violation of the priest-penitent relationship".

OK, who are the main players? Bertram Fields is acting as attorney on behalf of Tom Cruise of "Risky Business" fame. He is a very public attorney and leading human rights advocate, according to himself.

Marty Rathbun is someone who left the organisation calling itself the church of scientology because, he claims, of its serious human rights abuses and specifically the physically and mentally abusive nature of the "ecclesiastical" leader of the organisation, David Miscavige.

Marty published a series of revelations regarding his career in the St Petersburg Times (link provided) in which he claimed to be Tom Cruises' auditor (the equivalent to a confessor in the organisation calling itself the church of scientology and the belief known as scientology).

Tom Cruise, is Tom Cruise regardless of which film he's in; at least in my humble opinion, but hey he use to sell films so why not?

In Bertram Fields' strongly worded letter he states that Marty Rathbun:

"...repeatedly announced to the public that you were Tom’s ‘auditor’ at the Church of Scientology, and you have used that announcement, including Tom’s name, on your website to promote your business or profession."

which he claims:

"... is not only a serious invasion of Tom’s privacy and a violation of the priest-penitent relationship, it is the unauthorized use of Tom’s name to promote a business or professional venture, which is a clear violation of Tom’s common law and statutory rights."

We can deduce from the suggestion by Bertram that this is a "violation of the priest-penitent relationship" that Marty Rathbun was indeed Tom Cruise's confessor. Logically Bertram, being the clever attorney he is, would have slapped Marty really hard had the claim being untrue.

Naturally Marty Rathbun disagrees with Bertam's assessment of his actions and told him so in a rather lengthy response. Not only did the response deny the allegations made in Bertrams' letter but it also included counter allegations that:

David Miscavige, diminutive "ecclesiastical" leader of the organisation calling itself the church of scientology, did the following:

"....direct(ed) the public release of confessions, he suborned the perjury of a number of his underlings, and specifically had them state under oath that I never had a position of authority within the Religious Technology Center and had no training as an auditor."

Rathbun went on to say:

"The best evidence of that perjury is that in 2001 through 2003 Miscavige personally assigned me as Inspector General RTC (Religious Technology Center) – the second highest ecclessiastical position in the religion – to coordinate Tom’s divorce from Nicole and to serve as his auditor."

Rathbun then also stated that he had since:

"....counseled people who were abused by Tom personally – in matters that eerily resemble the behavior of Miscavige – to give Tom the time to get educated and do the right thing which I have convinced them he ultimately will do."

A clear allegation that Tom Cruise also committed physically and mentally abused others in the same way Miscavige does.

Just to get an idea of how serious an allegation this is it isn't just a matter of Tom Cruise getting irate like he did when interviewed a few years ago regarding psychiatry ("You DON'T know the history of psychiatry..". David Miscavige is accused of beating staff savagely to the ground. He is accused of orchestrating acts of physical aggression between his underlings.

To accuse Tom Cruise of abusing people like David Miscavige does is to say that Tom Cruise has abused his social status within the organisation to physically beat others.

Personally I don't really like Marty Rathbun, he's not exactly a saint in my opinion either, but the man had the guts to walk away from the organisation with nothing; even those in disgrace in the organisation tend to stay in it because it really is all they feel they have.

Actually in fairness to others still in Marty has family and they seem to be there for him, others may not have any living relatives; those in the USA and Canada can try toll free number 1-866-XSEAORG for people who will help them transition back to the real world.

We've already had admissions that physical abuse is tolerated within the organisation by Tommy Davis, the spokes person for the organisation. Now it seems we have an apparent admission that Marty Rathbun was Tom Cruises' confessor by Bertram Fields and all manner of allegations and hints at more intrigue involving the likes of Tom Cruise, what more will come out as this drama unfolds and the organisation calling itself the church of scientology implodes around its "ecclesiastical" leader David Miscavige?

29 months ago: The Kingpin has been revealed by Spokesperson Mr Tommy Davis as a notorious violent psychopath. How likely is it that such a person would be allowed to audit anyone, or to coordinate anyone's divorces, let alone for a Freedom Medal of Valor recipient who would expect the best and could have had his divorces coordinated by anyone he chose?

So, the Kingpin's story just doesn't add up. Top Lawyer Mr Bertram Fields is not a Scientologist and is rather elderly. Although apparently writing on behalf of his client, Mr Fields might have bought the Kingpin's story about being an auditor, believed the Kingpin had audited his client, and took it upon himself to write to the Kingpin without clearing up the facts with his client.

If someone had been audited by an unqualified psychopath, the audited persons would likely be entitled to have their levels re-audited by a non-psychopath auditor when they found out the auditing was ineffective and they had not actually completed the levels. That's not really anyone else's business, however. Why this obsession with celebrity?

Even if the Kingpin had really been appointed "Inspector General RTC", this might well be just a sort of ceremonial,figurehead role with little responsibility, that could be staffed by a psychopath if no one better is available at the time.

All in all, it's just a very confused story, due to the psychopaths involved, no doubt, with no substance that reflects badly on anyone currently in good standing, When the psychopath generated confusion is removed, there's nothing here that anyone could remotely be interested in.

Why would a psychopath be magnanimously giving Mr Tom Cruise "time to get educated"? Mr Cruise is a top-level Scientologist and professional level expert in several fields from aviation to acting to history and must be one of the top one hundred educated people on the planet.

I must respectfully address some of the finer points of your argument.
For one, it would seem that "The Kingpin" (I wish I had a nifty nickname like that! Maybe they could call me "The Saltshaker") was only 'exposed' as a 'a notorious violent psychopath' only after leaving the organization. Until that point, he was allowed to continue in the seemingly good graces of leadership. The very fact that it is acknowledged that he worked with Mr. Cruise reflects his status in the organization and perceived level of responsibility.
What that leaves us, then, is the denigration from a spokesperson with a certain vested interest in lessening 'the kingpin's' credibility, and a reference to an award given by the organization itself!
To put it in a different context, it's akin to the award that I just gave deanfox- the golden shower award, for the the way he 'showers' us with 'golden' statements and comments (maybe not the best name, but you see the point). This award is entirely dependant on my own opinion of his abilities and actions based on my own standards.
So, simply, please don't take Tommy D's word for it- there's more than meets the eye.

Please also note that it is quite an assumption, and an affront on the professionalism of Mr. Field's, to assume that he would breach his professional requirements in such a way as to write an official letter without consulting his client. It is rarely wise to insult a lawyer! :)

29 months ago: It's interesting that Rathbun is being (hysterically) accused of breach of confidentiality merely by stating that he was Tom Cruise's auditor. While the content of an auditing session is confidential, the identity of the auditor is not (and I used to be an auditor, so I should know). Imagine that Cruise was a Catholic instead of a Scientolgist, and had gone to confessional. Would the identity of his priest be considered a secret? I hardly think so.

This is just more nonsense from the cult.
