Just because it hasn't been mentioned yet, Sonia Sotomayor was confirmed overwhelmingly today as the newest Associate Justice, and the first Latino woman to hold the position.

30 months ago: Congratulations to her and her "first" status. I always said the world would be a better place if we could run at least one of every combination of people types through the Supreme Court. But it might get boring when we have to stop concentrating on ethnic backgrounds, so lets try a
quadriplegic anorexic cross-dresser from the Phillipines.



It's not the end of the world, even if she has a record of her rulings being flavored with bias. She can't serve as Justice forever, and the elections for president are only 3 years, 4 months away.
30 months ago: OOTB, as we've been talking about research all day, I'm assuming this time you've made sure to look over her judicial history and examine where she has sided with judicial precedent and where she has not, right? You haven't just looked at the firefighter case and concluded that it represents everything she's done in court, right?

Or do I need to spend a few more minutes with Google? ;)
30 months ago: I hope she truly is a "wise Latina." We've had enough old silver hairs (Uncle Thomas and Ginsburg ecluded) on the Bench. Curious to see how this plays out.

30 months ago: Oh yeah, and she'll be the first to tell you that a "wise Latina" is better than a white guy, hands down. And I hope we don't get any more Uncle Thomas types. I'm hoping Snoop Dog, or maybe Dave Chapelle will get his law degree, become a judge, and work his way up to the Supreme Court. Now that's entertainment!!


Noni, isn't one case enough? I mean, considering, it just happened recently.
30 months ago: No, one case isn't enough, especially in a case where the issues were so convoluted, even when it reached the prior Supreme Court, it was only partially overturned. Find me the current Justice who never had a case overturned by a prior SCOTUS.

Heck, in that regard, she's the Justice with the best record of following judicial precedent, hands down.

And you're still flogging the "wise Latina" thing? I thought that was over when the whole speech got published and people could see it in proper context. Oh wait, that's right, you guys operate off of soundbytes, not context. Remember what I said about Google? Here's a challenge: Look up the speech and read the whole thing. Skimming is allowed, because it's rather long. Besides, I think you'll be able to get the gist of it pretty quick. Then let me know if that wise Latina thing still bothers you.

30 months ago: I didn't have to Read it Noni, because when the story first broke, while I was polishing my guns and religious artifacts, (and I know you'll believe that's true, if you believe nothing else I'll say)and then blessing my guns with said artifacts, I had Microsoft Sam read it to me. It was just like being there.

This is why I feel she is biased:

"there is no objective stance but only a series of perspectives - no neutrality, no escape from choice in judging,"

"Whether born from experience or inherent physiological or cultural differences, a possibility I abhor less or discount less than my colleague Judge Cedarbaum, our gender and national origins may and will make a difference in our judging. Justice O'Connor has often been cited as saying that a wise old man and wise old woman will reach the same conclusion in deciding cases. I am not so sure Justice O'Connor is the author of that line since Professor Resnik attributes that line to Supreme Court Justice Coyle. I am also not so sure that I agree with the statement. First, as Professor Martha Minnow has noted, there can never be a universal definition of wise. Second, I would hope that a wise Latina woman with the richness of her experiences would more often than not reach a better conclusion than a white male who hasn't lived that life."

"In our private conversations, Judge Cedarbaum has pointed out to me that seminal decisions in race and sex discrimination cases have come from Supreme Courts composed exclusively of white males. I agree that this is significant but I also choose to emphasize that the people who argued those cases before the Supreme Court which changed the legal landscape ultimately were largely people of color and women."

This last statement is in direct opposition to the first, since the white judges would be, according to her, operating solely on a "series of perspectives".
30 months ago: Any oppressed people, regardless of ethnicity will be somewhat biased toward helping themselves and their people achieve a level playing field. Some folk are just nervous about this becuase it means a loss of power and control.

30 months ago: No Huey, we are nervous about this because it means the possibility of her abusing her power, and reinterpreting laws based on her own prejudices becomes greater. She already has said that one of her primary functions is legislation from the bench.

If you feel insulted because I have pointed this fact out. I am sorry. However, I ask you to really dig deep and find your own cause. Other than the old "step and fetch". That is why your brothers and sisters paid such a cost. BTW, along with many of my family which died in WWII combating the weakness of the people to stand up and be heard.
30 months ago: No seriously, stop. I am not a Nazi (and that is what you mean when you talk about National Socialism). Sonia Sotomayor is not, either; they wouldn't have accepted either of us anyway, because of our ethnic backgrounds. We would have been in the gas chambers, not operating them.

I think I'm through with you. I've tried being polite, but you're not capable of understanding just how offensive you're being.

30 months ago: Maybe you'll want to call me cynical or skeptical, but it seems to me all justices rule somewhat from their prejudices and interpret the law due to their own biases. Naturally this can lead to an abuse of power. Nature of the beast.

I'll be glad when Roe v. Wade gets the boot. Don't know if Sotgo can legislate that one away or even wants to.

30 months ago: Ironic that alleged socialist II was confirmed by alleged socialist I thanks to Bush I nominating alleged socialist II to the District Court bench back in 1992. Now the fundys will say that Bush was forced to bow to the will of Dems, but of course there's no evidence for such, and if she was that bad, Bush should of grown a spine and said no.
