BOSTON (Aug. 20) --A cancer-stricken Sen. Edward M. Kennedy has asked Massachusetts leaders to change state law to allow a speedy replacement if it becomes necessary for him to surrender his seat, fearing a months-long vacancy would deny Democrats a crucial vote on President Barack Obama's health care overhaul.
In a note to Gov. Deval Patrick and other state leaders, Kennedy asked that lawmakers allow the governor to appoint an interim replacement pending election of a successor, to ensure there would not be a period with a vacancy. Currently, the law requires a special election to be held within 5 months.

the state changed its succession law in 2004 to require a special election be held 145 to 160 days after the vacancy. At the time, legislative Democrats — with a wide majority in both chambers — were concerned because then-Republican Gov. Mitt Romney had the power to directly fill any vacancy created as Democratic Sen. John Kerry ran for president.

33 months ago: That was a permanent fill. At the time, the governor could appoint someone who would fill out the rest of a senatorial term. Ted Kennedy, who just died, was asking not for a permanent fill, but for the governor to be able to appoint someone to fill the seat only until the special election.

33 months ago: Not spin, just fact. Go ahead, prove me wrong. Look up state law on appointing senators before the special election law was created. Then look at what Kennedy was asking for before he died. Then perhaps you should see if you can look yourself in the mirror after unjustly maligning a dead man.

Basically your right he only needs someone in there temp. to vote for health care. Now how important is that seat that it can't wait? That will be another discussion if you want to get slammed on a bit. Non I feel for you, its sad, your just a little lamb waiting for the slaughter.
33 months ago: you know what i could not let this go, i just had to say something else. First thing you need to know i am not republican i am actually a registered dem. however i am a sane person that can recognize insane things. If Ted wanted the position to be fill temporarily than when he got it changed the first time he would have done it, but he didn't he wanted to block a republican and having it as a temp. position would have given ol mitt the spot. This is insane--anyone can see this is not good politics. We need to forget our party lines here and be angry that politicians can do this..dem. rep. ind. it does ont matter!! You need to understand that this is not right and you need to stand against tings like this this is a gross misuse of power.

33 months ago: I'm not maligning anyone. All's fair in love and war, and this is war. Proof is, the law was changed to prevent Romney from nominating a Republican Senator to replace Kerry. It was o.k. back then to have a 5 month vacancy, rather than have an extra Republican senator.
Now the shoe is on the other foot, and Democrat Gov. Patrick can't appoint a Democrat to vote for for health care. The best laid plans of mice and men....and all that rot. Now when they get called on changing the rules to suit their ends, they just shrug and say, "What? Who, me?"

I can look at myself just fine, my melodramatic friend. I don't care if the man is dead or not. Just because you die doesn't give you a free pass. I don't see a whole lot of people focusing on the good points of Ted Bundy.
