Protection of protected species, a Federal crime

It is a Federal offense to protect the protected species. A little 11 years old girl from Virginia had to learn this the hard way. Young Skylar Capo never realize that her act of saving a baby Woodpecker from a cat could end up in a $535 fine for breaking the Federal Migratory Bird Act!

Apparently, after she managed to save the baby bird from a hungry cat and the bird's mother was nowhere in sight, little girl managed to convince her mother to let her care for a baby woodpecker until it was well enough to fly on its own.

Two weeks later, U.S. Fish and Wildlife Service showed up at Capo's front door accompanied by an armed Virginia State Police trooper. I guess that coming alone would not be scary enough. 11-year-old girls can be dangerous sometimes, especially when being told that her noble act resulted in mommy losing more than $500!

I have to say that the Virginia State Police behaved honorably throughout entire incident. The trooper just stood on the porch and said nothing. They had to show up since US Fish and Wildlife agent requested their presence. Also, The Virginia Department of Game and Inland Fisheries did not take part in this.

I don't know why but when I read about something like this I remember the words of US Declaration of Independence that King George III "erected a multitude of New Offices, and sent hither swarms of Officers to harass our people, and eat out their substance."

Welcome to the New World Order. Federal agencies in the United States have extraordinary power. They can seize your assets, freeze your bank accounts, intercept your emails… all without any a court order or reasonable form of oversight...

8 months ago: Funny thing, the bird was released after recovery and it flew away. The girl's mother informed FWS about this but FWS messed up and processed the case. I just love their official statement:

"Upon speaking with the subject, later identified as Alison Capo, on June 27, the agent determined that no further action was warranted. A citation that had been previously drafted by the agent was cancelled on June 28.

Unfortunately, the citation was processed unintentionally despite our office's request to cancel the ticket. The Service has contacted Ms. Capo to express our regret. The Service is also sending Ms. Capo a formal letter explain the clerical error and confirming that ticket should never have been issued.

This misunderstanding was the result of a Service inquiry into possible violations of federal wildlife law. In particular the Service is responsible for the protection of all federally listed migratory birds. The Virginia Department of Game and Inland Fisheries did not participate in the inquiry."

8 months ago: I wonder who informed who and how they knew who to inform and why they know that to inform about a migrating woodpecker being rescued from a cat would be of interest. War, pestilence, natural disasters, genocide, meltdown of the planet's natural resources, collapse of financial systems, murder, sexual abuse, riots, robbery, girls rescuing birds ...

8 months ago: My guess is that they are Tea Party and the Progressives next door on the commune were pissed because they had to feed the cats that night.

8 months ago: According to FWS, "On June 13, a special agent with the U.S. Fish and Wildlife Service observed a woman carrying a cage that contained a woodpecker at a home improvement store in Fredericksburg Virg."

So, watch out, you never know when you might be observed by a special undercover FWS agent!

8 months ago: I suspect the intent of the law is to prevent people from trading in protected species. If an agency gets a complaint they need to respond and it sounds like they had no idea of the actual circumstances or that it was an 11 year old not her mother that had the bird in a cage. However after they figured out what was going on they issued an apology. Mistakes happen.

The title of the piece is misleading. There is nothing wrong with rescuing any critters in need.

In our town if you find an injured bid or other animal you can contact an agency that has professionals on staff that will have a better chance of nursing the injured bird to health. They know about the proper nutritional needs etc. If you don't have a similar facility in your community you can call some official agency like the animal control, police, or county agency, and they will know who can best care for the animal. http://www.eraptors.org/rescue.htm

Regardless of the law, this should never happen.

I wonder if you would think that it's all OK if some masked guys dropped in in your home and held you incommunicado for a couple of days in Guantanamo and apologized for their mistake later on? After all, they are here to protect us...
8 months ago: Actually it was the FEDs. But then again. The left coast states have the same goals. They can't ever mow the yard with a gas powered lawnmower.

The law is pretty specific and written so that only "qualified" and "certified" wild fowl/game/critter personnel are allowed to capture, rescue, feed, care for and whatever else you can say that prevents the common citizen from doing their moral duty to care for those that can't care for themselves or who need help.

Just pick up an eagle feather off the ground, put it in your hat band and see how fast the feds come knocking at your door to charge you, arrest and fine you for having that protected item in your possession (native Americans are exempt from that one).

Just one more way our government has overstepped its authority by legislating our personal rights away.
8 months ago: As for the trooper being armed.... let's hope they always show up armed with their proper equipment. I would hate to hear that they were like English Bobbies running around with whistles and sticks chasing bad guys with Uzis.

Kind of shows the authors feelings about guns....... Would have been better to just say he was there and not mention that he was properly attired with a weapon.

8 months ago: The reason I mentioned that the trooper was armed is because the only reason for the presence of State Police was a request by FWS for armed protection.

I certainly do hope that all troopers are always armed since their job is usually far more dangerous than accompanying FWS agents to a little girl's doorstep!
