This allows the "captain of the ship", or administrator or judge or the President, leave to disregard any provision of such a constitution at his discretion. That is why nearly all "public officials" know that the real constitution does not apply to them, for they are a Foreign State and a Foreign Agent, which have never filed for protection by signing up as a Foreign Agent, under the Foreign Sovereign Immunities act.
