It's Time...


Under United States Federal Law, a riot is defined as:
A public disturbance involving (1) an act or acts of violence by one or more persons part of an assemblage of three or more persons, which act or acts shall constitute a clear and present danger of, or shall result in, damage or injury to the property of any other person or to the person of any other individual or (2) a threat or threats of the commission of an act or acts of violence by one or more persons part of an assemblage of three or more persons having, individually or collectively, the ability of immediate execution of such threat or threats, where the performance of the threatened act or acts of violence would constitute a clear and present danger of, or would result in, damage or injury to the property of any other person or to the person of any other individual.18 U.S.C. § 2102.
As every state in the United States has its own laws (subject to the Supremacy Clause), each has its own definition of a riot. In New York State, for example, the term riot is not defined explicitly, but under § 240.08 of the N.Y. Penal Law, "A person is guilty of inciting to riot when he urges ten or more persons to engage in tumultuous and violent conduct of a kind likely to create public alarm."

What is clearly missing in this definition and the point that leaves this entire situation up for debate is "time". The question is; does a person or group of persons have to witness an immediate response to their inciting intentions for it to qualify as "Inciting a Riot".

First...Some Almost Fiction
Lets say....A "news organization" contrives a story. This story is pulled out of thin air and filled with falsehoods in an effort to "float an agenda". The agenda; re-define obstructionism to the nth degree and make everything that this radical, racist, uneducated, inept, inexperienced idiot of a President stands for, look as if his head has permanent residency up his anal cavity.

The model; duplicate the energy and malfeasants from a year ago...

You remember how they made people who have no medical insurance argue vehemently against getting medical insurance, or how about the time they convinced 32% of America that our PRESIDENT was a not a real citizen of the United States.

Their Company Charter illustrates that these "Gullible Americans" will argue about any issue this "news organization" creates as long as the "news organization" repeats and repeats and repeats the story.

The end result, our Leader is made to look like the second coming of Lucifer and an Uber-Conservative is elected to the White House in 2012. And, if the "news organization" plays their cards right, they will have front row seats to the downfall of this Presidency.

For added context, think of this analogy... What if you created a job title Arsonist-New Reporter. It's safe to say that you would have the scoop on EVERY fire that "accidentally" ignites in the city.

After watching several of these destructive fires on the 6 o'clock news, us "Gullible Americans" should wake up and hold that arsonist accountable for the immeasurable destruction that he has caused.

Now...For Some Reality
Fox News purposely contrived this nonsense Muslim Mosque controversy and repeated it every day, all day until us "Gullible Americans" took the story as credible. We chose sides and argued our position on why they should or should not build this community center. Then Fox News fanned the base of the fire and brought in their fake "experts" to voice their concern. We listened to their fake "experts" and developed more opinion about the fake positions they were taking. We sought out our own "experts" to counteract the fake "experts" put forth by Fox News.

Fox News dialed up their partner in crime at Rasmussen Reports and asked them to come up with controversial numbers to solidify the argument for or against the Mosque. Rasmussen Reports asked all of their employees how they felt about the Mosque then broadcast that the "overwhelming majority of those polled by Rasmussen" are against the building of this Mosque. Cue the lightning, the storm clouds and the mysterious chamber music, and a BREAKING NEWS STORY is born...

Bus in a few hundred protestors to Lower Manhattan, solicit the support of a few distraught and misguided family members of those slain on September 11, 2001, then sit back and report on the spontaneous outrage in the community for this hideous idea of building a Mosque two blocks from the World Trade Center.

John Hammond (the fictional CEO of InGen and architect of Jurassic Park) learned a valuable lesson when his experiment evolved to live outside the beaker, and his dinosaurs started to reproduce. It is time that Fox News suffers the same downfall.

Because of their experiment, an African American union carpenter working at ground zero, looking vaguely like the "enemy Muslim" that Fox News has created happened to walk near a crowd that was protesting the building of the Mosque. Because of his similar appearance, protestors confronted him and shouted obscenities before escorting him out and telling him that he is not welcome.

Because of their experiment, Micheal Enright entered a taxi cab yesterday and engaged the driver, Ahmed Sharif, in a conversation about his heritage and background. After a moment of silence, Enright screamed obscenities at Sharif then began slashing and stabbing Sharif multiple times from the back seat.

Enright was subsequently arrested and held on Attempted Murder Charges with a Hate Crime enhancement.

One of the "concerns" that Fox News has with the Obama Administration, is that they often appear to be weak on the issues that threatens American peace and civility. They beg that the DOJ and Attorney General Eric Holder show some "balls" and go after those who threaten the "Gullible Americans" and here is where I find myself in agreement with Fox News.

Mr. Holder, please show some balls and pursue charges against Rupert Murdoch and his minions for inciting this riotous behavior amongst our citizens, which has resulted in the attempted murder of a fellow American and the constant threat of safety to an ENTIRE religion. That's all we ask...

Nothing More, Nothing Less.

21 months ago: as Keith Olbermann says: Fixed News. And it really is astounding that a "news" channel is allowed to call itself a "news" channel, when its clearly propaganda.
As Bob Cesca said in his post yesterday:
A major feature of the Strategy: never draw the conclusion. Some examples. A black woman was talking about white people -- and you know what that means. Mexican babies are automatically citizens -- and you know what that means. The president with his mysterious religion and unusual name said positive things about Muslims -- and you know what that means. We don't know where Imam Rauf is getting his money -- and you know what that means. Wink, wink. White rage is successfully tweaked. Mission accomplished.

21 months ago: Well if you are going to prosecute Fox News, don't waste your time with a few hate crimes. How about the invasion of an entire country that had not attacked us (but they led us to believe they had), had no WMD (but Fox convinced us they did), and was not a threat to us (but Fox brought up the image of a nuclear cloud )

Instead of one or two lives how about prosecuting them for the 4,000 and counting Americans, plus the hundreds of thousands of Iraqis?

Of course Fox isn't entirely responsible, they were just a tool. Part of a larger propaganda apparatus that included all of hate Radio, funded by the Koch brothers and many others.

Since the media is 95% liberal news, these commies see Fox as the baddest guy in town.

I find that the news media needs a balance and 95% to one is not a balance.

21 months ago: Your comments are interesting...and predictable. In reading the rants and raves of all those who responded, I could have predicted what each would say.

My goal is and always has been to appeal to the common decency of communal living. In other words, at face value, what Fox News has identified as their "threshold" is totally Anti-American. The rhetoric they put out, with the intent to harm Democrats is actually harming the country, because it is not just Americans who watch this channel.
Be an obstructionist, that's fine, but must you do so in such a way that we erase the reputation of freedom and liberty that many have fought and died for.
Because it is not in accordance to their "master plan" the organization is lobbying to change the constitution to a degree that floats their agenda.
Another example is our inclusion of torture in our detentions now. The GOP and Fox News has claimed that "yes we did enhancely interrogat (torture) them but we did so to protect our country" now, while that may appease an argument today and shut their opposition up, what happens 5 years from now when American soldiers are captured in a foreign land that is intent on "protecting their country" are we going to forgive them for torturing our soldiers. Anddont give me that, "well they beheaded our journalist and tortured us in the past", we know that and we should be taking a position that we are better than them. This was pay dividends towards us in be long run. And quite frankly, we ARE better than them.
But, in an effort to push their agenda, the GOP and Fox News is willing to throw out the baby (The United States) with the bathwater (The Obama Administration)
And that is gonna kill us!
Solution: Stop the bleeding and prosecute Rupert Murdock, Limbaugh, Beck and the whole lot of em

21 months ago: OOTB had some good points. Yes most of the Democrats got behind the president and did vote for war. But that just shows the effectiveness of the propaganda machine.

Achmed Chalabi a favorite of the Neocons, is the one that gave The Bush Administration a source inside Iraq that scared the bejeesus out of the intelligence community. Cheney had his own intelligence clan that criticized the CIA for questioning the veracity of this source, and which cherry picked "evidence" which supported their agenda. Most Democrats are patriotic and like to think that our intelligence agencies are doing a good job and not being manipulated by one man (as it turned out everything this source fed the agencies was false and also supportive of the aims of Iran). So most Democrats supported their president. At that point they didn't realize that they were being manipulated, so it is easy to go back and take instances out of context and make it seem that they supported the war.

In fact the resolution they supported was not to go to war but to bring UN inspectors in and in conjunction with the UN to allow the UN to go in if they found weapons. The Democrats supported International law, the Republicans did not.

Fox came into the picture early on to manipulate public opinion (which the politicians followed). Scott Ritter a former weapons inspector started speaking out saying, hold on the WMD just aren't there, he was castigated. When the UN inspectors came into the country Cheney said we know where the weapons are. The inspectors went wherever we told them there were weapons, and they weren't.

Finally Bush pulled the inspectors out when it became painfully obvious that they were proving that there were no WMD, and that because of that the UN would not support an invasion. The Democrats supported keeping the inspectors looking and opposed going in, But Bush had his own agenda, and decided to invade the country unilaterally (with a few lap dogs) in opposition to international law and against the wishes of the UN. Fox and the rest of hate radio and the media continued to castigate dissenters and push for war. They were very effective at that job.

Now the same propaganda machine has been turned to demonizing Obama and resisting anything the Democrats do even when it is painfully obvious that what the Democrats are doing is best for the country. Fox is more concerned with what is good for the Republicans and the extreme right wing than they are with the good of the country. They are extending the recession by doing all they can to destroy consumer confidence.

We should all be pulling together in these times of crisis and instead Fox and co. is concentrating on hate mongering to keep us divided.

21 months ago: The resolution "supported" and "encouraged" diplomatic efforts by President George W. Bush to "strictly enforce through the U.N. Security Council all relevant Security Council resolutions regarding Iraq" and "obtain prompt and decisive action by the Security Council to ensure that Iraq abandons its strategy of delay, evasion, and noncompliance and promptly and strictly complies with all relevant Security Council resolutions regarding Iraq."

The resolution authorized President Bush to use the Armed Forces of the United States "as he determines to be necessary and appropriate" in order to "defend the national security of the United States against the continuing threat posed by Iraq; and enforce all relevant United Nations Security Council Resolutions regarding Iraq."

It is clear that the intent of the resolution was to support the UN, but Bush took that one sentence "authorized President Bush to use the Armed Forces of the United States "as he determines to be necessary and appropriate" to be an authorization of war.

It was not an authorization to go to war unilaterally and illegally without the backing of the UN.
