Age Discrimination is running rampant

Age Discrimination is running rampant in the search for employment today. I have been filling out applications for the passed two years now. During this time I have noticed a change in the question they ask on Applications. In the last week I have had 3 major companies ask illegal questions. Summary of Legal and Illegal Questions
1. My birthday
2. If I'm over 21
3. If I'm under 25
4. If I'm under 40
5. My mother maiden name
6. My Sex
7. My nationality
Now some of these companies say these questions will not be used for the hiring process. But if not answered it could slow down the hiring process. But if this was true then why do they ask these questions before they interview or hire you. And Some of these question are ask for tax purposes so the can receive a tax credit if they hire you. But also they should not be used in the hiring process. Now many people wonder why they can't seem to get a job. Well from what I see age has a very big part in this. And if anyone is being asked illegal question on applications they need to contact the EEOC, because this needs to stop. Jobs are hard enough to come by now a day any kind of discrimination is wrong and should not be tolerated. U.S. Equal Employment

14 months ago: I recently dealt with the EEOC on Discrimination, not age but race. I am an Anglo, and I was fired for missing sales quotas four consecutive times, yet some Latin salespeople had also missed quota four times or more and were not fired. I had detailed information and could easily prove my point and yet the EEOC dragged their feet investigating.

Age Discrimination is even harder to prove and it has been going on for years. Only recently with the huge amount of people unemployed and the 99'ers has it become more obvious. In order to prove you were not hired you would need to know who and how old the other applicants were that were turned down and who and how old the applicants that were hired were.

The EEOC may investigate and if they feel there is a case they will give you a letter allowing you to file suit. Of course you could file a lawsuit on your own, but it would be costly and most discrimination cases do not award a lot of money. Lawyers are not likely to take such cases on a Contingency Basis, meaning little or no money from you upfront and the lawyer gets paid if you win.

The companies know you don't have a lot of money and will probably not sue them. Even if you did sue them for Age Discrimination all they need to do is present one or more applications from younger people that they turned down and they win and you lose. The EEOC knows this too of course.

I wish you all the best if you choose to pursue your Age Discrimination charge, but the odds are stacked against you.
14 months ago: Hey Cully I know what your saying I too have went through the EEOC and it took 2 years to get a right to sue letter. It was a pain in the butt to deal with but it did work out in the long run. But What I mean in what I wrote is not that you are not being hire because they hired someone younger then you. It's they are asking your age first , asking your birthday on applications and and tossing it because of your age. I have never seen this in my life asking for your birthday its a illegal question to ask on a app.

The ADEA does not specifically prohibit an employer from asking an applicant's age or date of birth. However, because such inquiries may deter older workers from applying for employment or may otherwise indicate possible intent to discriminate based on age, requests for age information will be closely scrutinized to make sure that the inquiry was made for a lawful purpose, rather than for a purpose prohibited by the ADEA. 14 months ago: Kqm2010 - These companies get around the age thing because no one has the energy to fight everyone, and you need that paycheck. The idea is to get hired. It is the luck of the draw every time. You can do the best job and still get harassed to death. If the company hires you and some people don't like you to begin with, they can make it miserable for you. Best to keep searching for a job where people are similiar. When the right job comes your way, you will get it without any problem. I'll tell you that the skilled younger people are finding it hard to get back to the work they are accomplished in. Many have taken big pay cuts. I'm going to school, but who knows if I'll get a job. When you apply for a new job, they want experience of 2 or 3 years.
